VPN Alliance Terms of Service:

Please read the following terms of service (the "Terms") carefully before signing up for an account and using the VPN Alliance Services. These Terms are a legally binding agreement between you (an entity or person) and VPN Alliance. By proceeding to establish an account and/or use the Services, you agree to be bound to the terms of service stated below. If you do not agree to all of the Terms, you must not sign up for an account or use the Services. 

 

These Terms govern the relationship between you (the "Customer" or "you") and VPN Alliance. VPN Alliance provides its traffic tunneling and encryption services (the "Services") to Customers who establish an account. You must be at least 18 years old to establish an account. By establishing or using an account with VPN Alliance, you agree to be bound by the Terms and to use the Services in compliance with the Terms and any other policies posted on the website. These terms may be modified at any time; it is the responsibility of the Customer to seek out the updated terms on VPN Alliance’s website. Updated terms are valid from the time they are published on VPN Alliance’s website.

 

If you are signing up for and using the Services on behalf of a business or organization, you agree to these Terms for that business or organization and acknowledge that you have the authority to represent that business or organization and commit to these Terms on behalf of all individuals and parties involved.

 

PAYMENT:

You must provide VPN Alliance with accurate billing information in order to successfully process payment including your legal name, email address, and credit card/billing information, and report to VPN Alliance all changes to this information within 30 days of the change. You are responsible for any charges to your account. If you have questions regarding charges to an account, you should contact VPN Alliance's Customer Support Department by email at support@vpnalliance.net. All charges are considered valid unless disputed in writing within 30 days of the billing date. Adjustments will not be made for charges that are more than 30 days old unless VPN Alliance, in its sole and reasonable discretion, decides to make an exception for extenuating circumstances.

 

Charges are billed to your credit card each month for the applicable Service plan and any additional usage, equipment, or services. VPN Alliance is not responsible for any charges or expenses (e.g., for overdrawn accounts, exceeding credit card limits, etc.) resulting from charges billed by VPN Alliance. Delinquent accounts may be suspended or canceled at VPN Alliance's sole discretion. However, charges may continue to accrue until the account is cancelled and collection, chargebacks, and late fees or other similar fees may be added. VPN Alliance may bill an additional charge to reinstate a suspended account.

 

Your successful payment results in VPN Alliance granting you a limited, temporary, and nontransferable license to download the VPN Alliance software and access the VPN Alliance Services described in your chosen tier of Service for the period of your subscription. This does not grant you any other licenses, rights, or ownership of VPN Alliance’s software or services. Any commercial use without the express permission of VPN Alliance is prohibited. The license granted to you is valid for your subscription period, unless terminated earlier by the Customer or by VPN Alliance for any reason, including but not limited to violation of these Terms.

 

PRIVACY:

VPN Alliance has a strong commitment to privacy and operates with a robust no-logging policy. VPN Alliance does not monitor, collect, log, or store Customer usage data including browsing history, identifiable connection timestamps, IP addresses, DNS queries, traffic logs, and other data. VPN Alliance must only collect the email address and some basic billing information from each Customer to allow for the necessary payment processing and correspondence. This information is processed automatically and is not sold to or shared with any third-parties.

For Users in the European Union:
For our Customers in the European Union, The General Data Protection Regulation (GDPR) requires us to explain our data collection and retention practices. 
In keeping with the GDPR, VPN Alliance collects and processes aforementioned data in this Privacy Policy only for the following lawful purposes:

  • To fulfill our contractual obligations with the Customers, including:

    • Providing customers with Services they have requested

    • Processing Customer payments and managing subscriptions.

    • Providing Customers with support. 

  • For legitimate interests associated with the operation of VPN Alliance, including:

    • Continuous quality improvement of our site and the Services.

    • Providing information to the Customers and seeking feedback related to the site and the Services.

    • Receiving knowledge about how the site and Services are being used.

  • With the consent of our Customers, which the Customer can withdraw at any time.

You can exercise your rights under the GDPR to access, transfer, correct, delete or object to the processing of your personal information by contacting us at support@vpnalliance.net.
 

 

COMMUNICATION:

VPN Alliance will use the email you have provided when creating an account for all communication with you, the Customer. You may be notified of any changes to or suspensions of the Terms or the VPN Alliance Services with the email you provided, although you are not required to be notified; any notifications VPN Alliance provides are simply a courtesy, and the Customer is solely responsible for acceptance of any changes to the Terms or Services which will be posted on the VPN Alliance website whenever relevant. 

 

ACCEPTABLE USE POLICY:

VPN Alliance has a Zero-Tolerance Policy regarding abuse of the Services and violation of the Terms. VPN Alliance does not condone, endorse, or allow any unlawful, criminal, or fraudulent activity conducted while using the VPN Alliance Services. VPN Alliance reserves the sole right to terminate any account found to be in violation of the Terms. You alone are entirely responsible for the use of the Services on your account; if you suspect your account has been compromised, you must notify us so we can issue new credentials. 

 

While using the VPN Alliance Services you agree not to commit or take part in any of the following actions:

 

  • Using the VPN Alliance Services for unlawful, illicit, illegal, criminal, malicious, or fraudulent activities.

  • Running or operating any server for the purposes of creating or distributing spam emails or unsolicited advertisements, and/or attempting to distribute spam emails or unsolicited advertisements.

  • Violating or infringing any intellectual property rights, copyrights, or any other proprietary content and data rights. 

  • Sending, posting, transmitting, creating, downloading, uploading, or distributing any content which is illegal, hateful, harmful, threatening, defamatory, harassing, or aiming to incite acts of violence.

  • Attempting to interfere with the regular operation of VPN Alliance’s Services or transactions, or with another Customer’s use of the Services.

  • Engaging in any conduct that is exploitative of minors, or uploading, downloading, posting, reproducing, or distributing any content that includes sexual or explicit depictions of minors.

  • Uploading or distributing any files that contain viruses, worms, trojans, corrupted files, or any other programs or files that may damage the operation of an individual’s computer or internet enabled device.

  • Attempting to “hack,” take control of, sabotage, or intercept data from anyone’s computer, network, server, or internet enabled device. 

  • Probing, scanning, or testing for any vulnerabilities of a system or network to bypass security measures or collect the data of any individual or entity without their explicit knowledge and permission.

  • Using the Services to attempt a denial of service (“DoS” or “DDoS”) attack on VPN Alliance, its Customers, or any related or unrelated individuals. 

  • Using the Services to violate any laws at the local, state, federal, or international level applicable in the country, state, or territory in which you reside.

  • Infringing or violating these Terms in any other way.

 

VPN Alliance reserves the right to investigate any matters we consider to be violations of the Terms and these policies. We may, but are not obligated to, in our sole and reasonable discretion and without notice, remove, block, filter, or restrict by any means any materials or information that we consider to be actual or potential violations of these Terms. VPN Alliance may, in its sole and reasonable discretion, choose to terminate a Customer’s account without giving notice if the Customer is thought to be in violation of these terms.

 

LIMITATION OF LIABILITY:

The Services are provided on an "as is" and “as available” basis. VPN Alliance does not warrant that the Services will be uninterrupted. VPN Alliance makes no warranties, express, implied or statutory, and the Customer waives all warranties, including, but not limited to, warranties of title, noninfringement, merchantability, and fitness for a particular purpose regarding any merchandise, information or service provided by VPN Alliance or through VPN Alliance directly or indirectly. No advice or information given by VPN Alliance or its representatives will create a warranty. VPN Alliance and its employees are not liable for any costs or damages arising directly or indirectly from your use of the Services, including any direct, indirect, incidental, exemplary, multiple, special, punitive, or consequential damages. In any event, VPN Alliance’s cumulative liability to any customer for any and all claims relating to the use of the Services and/or licensed programs will not exceed the total amount of service fees paid during a one year period preceding the accrual of the claim.

Some states or jurisdictions may not allow the limitation of liability for direct, indirect, incidental, exemplary, multiple, special, punitive, or consequential damages. In such states or jurisdictions, VPN Alliance's liability to you shall be limited to the full extent permitted by law.

 

INDEMNIFICATION:

You agree, at your expense, to defend, indemnify, and hold harmless VPN Alliance and its affiliates, officers, directors, employees, and contractors from and against any and all costs, damages, and reasonable attorneys' fees resulting from any claim that your use of the Services injured or otherwise violated any right of any third-party or violates any law. This section will survive the termination of these terms.

 

WARRANTY DISCLAIMER:

Except for certain products and services specifically identified as being offered by VPN Alliance, VPN Alliance does not control any materials, information, products, or services on the internet. The internet contains unedited materials, some of which are sexually explicit or may be offensive to you. VPN Alliance has no control over and accepts no responsibility for such materials. You assume full responsibility and risk for use of the Services.

 

SERVICE LEVEL AGREEMENT:

VPN Alliance Service coverage, speeds, server locations, and quality may vary. VPN Alliance will attempt to make the Service available at all times on a “best efforts basis”. The Services may be accessed worldwide, but we do not guarantee that the Services are appropriate for use in your location and jurisdiction. It may be illegal for VPN Alliance to offer Services in certain countries due to trade embargoes; as a result, we do not offer the Services in Iran, Syria, North Korea, Myanmar (formerly Burma) and Sudan, and in any locality considered a “rogue state” or terrorist organization by the Export Administration Regulations of the U.S. Department of Commerce’s Bureau of Industry and Security.  

 

The Services may be temporarily unavailable for a variety of reasons beyond our control, including but not limited to emergencies, third-party-service failures, or network problems or limitations. VPN Alliance is not in any way responsible for data, messages, or pages lost, not delivered, delayed, corrupted, or misdirected because of interruptions or performance issues with the Service. As deemed necessary, in our sole and reasonable discretion, we may limit data rates to provide more evenly distributed data and a more equitable experience for all Customers. Additionally, we may, but are not obligated to, block access to certain websites, software, or content that may cause damage to the Services or to the Customers’ experience.

 

The Services VPN Alliance provides exist solely for the purposes of privacy and security. These Services include but are not limited to access to VPN Alliance’s array of physical and virtual servers and routers to allow for connection tunneling, advanced end-to-end encryption, IP address masking, and encrypted DNS. 

 

Different tiers of Service pricing allow the Customer to have different maximum download/upload speeds, as well as different maximum numbers of devices connected to the Service simultaneously; additionally, different tiers may restrict or allow use of the Service on various devices or types of devices e.g. one tier may not allow installation and use of the Services on wireless routers. Any Customer who is found to be attempting to circumvent these allowed maximums and any other restrictions may have their account terminated by VPN Alliance without notice. 

 

TERM OF AGREEMENT:

Continued use of the Services constitutes acceptance of the Terms and any future versions. If you are dissatisfied with the Services or any related terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the Services and terminate your account.

 

COPYRIGHTS AND TRADEMARKS: 

All content included on VPN Alliance’S website, including, but not limited to, text, graphics, logos, buttons, icons, images and software, is the sole property of VPN Alliance or its licensors or partners and is protected by U.S. and international copyright and trademark laws. Reproduction, duplication, modification, distribution, transmission, replication, display or performance of the content of the website without the express written permission of VPN Alliance is strictly prohibited and will be met with legal action when deemed appropriate in our sole and reasonable discretion.

 

TERMINATION:

You may terminate your account at any time and for any reason by providing notice of intent to terminate to VPN Alliance at least 5 days prior to the end of your billing cycle. Notice must be provided by email to support@vpnalliance.net. Your termination will only be complete upon your receipt of a cancellation confirmation from support@vpnalliance.net. If a termination notice is received at least 5 days prior to the end of your current billing cycle, termination of your account will be effective at the end of your then current billing cycle. If a termination notice is received less than 5 days prior to the end of your current billing cycle, charges to your account may continue until the end of the following billing cycle. 

 

Without prior notice, VPN Alliance may terminate these Terms, your password, your account, or your use of the Services, for any reason, including, without limitation, VPN Alliance, at its sole discretion, believes you have violated the Terms or any of the policies applicable to customers, or if you fail to pay any charges when due. VPN Alliance may provide termination notice to you by email. 

 

REFUNDS:

Customers may claim a refund within 30 days of signing up for VPN Alliance’s Services. However, we are committed to full Customer satisfaction and would prefer to troubleshoot any issues you are facing. The Services are complicated and there are common configuration issues that can easily be resolved. VPN Alliance may consider issuing refunds past the 30 day window if the Customer can prove that the Services were unavailable or unusable during this time and that the Customer notified VPN Alliance of the issue and provided all of the necessary information. VPN Alliance, in our sole and reasonable discretion, will decide if a prorated refund will be issued for a period in which the Services were unusable or unavailable past the 30 day window.

 

DMCA AND ABUSE POLICY:

VPN Alliance respects the intellectual property rights of others and expects its Customers to do the same. Due to our privacy and no-logging policies, we are generally unable to provide any personally identifiable DMCA or general abuse related information. However, if you would like to file a copyright infringement notice, please continue reading. 

 

To file a copyright infringement notice with us, you must send to abuse@vpnalliance.net an email that includes all of the following:

 

  • An electronic or physical signature directly from the copyrighted work owner or an authorized person.

  • A description of the copyrighted work, including a URL where the infringing content can be found or a full copy of it. 

  • Your contact details including legal name, email address, telephone number, and mailing address.

  • A statement in “good faith belief” that the work is not authorized by the copyright owner.

  • A statement by you, the sender of the take-down notice, that the information in the notice is accurate and complete, and that you are either the copyright owner or you are authorized to act on the copyright owner’s behalf.

 

We will review and address all notices that comply with the requirements listed above. If your notice does not comply with all of the requirements upon review, we will be unable to address it properly and may not respond. 

 

For general abuse inquiries, please provide the IP address and port where the abuse took place, and we will do what we can. Although our privacy policies prevent us from collecting IP addresses, in some cases we will be able to block certain ports to mitigate further abuse. 

 

We suggest that you consult your legal advisor before filing a Notification of Claimed Infringement. Please note that you may be liable for damages if you make a false claim of copyright infringement. Section 512(f) of the Copyright Act provides that any person who knowingly materially misrepresents that material is infringing may be subject to liability. Please also be advised that we may terminate the accounts of Customers who repeatedly misidentify copyrighted material.

 

 

VPN Alliance reserves the right to update or modify these terms and conditions at any time. Notice may be provided to the customer via email.

Speed and Latency

The VPN Alliance network is global, yet our main services route all data back to the United States. This can cause some higher latency for those located outside of the United States, but is required to maintain maximum privacy and security. We do have servers in other countries around the world which can be accessed by sending us a direct request via email including your approximate location. For our US customer base, expected latencies should be around 10ms to 40ms. Speed and latency depends on many external factors including your connection type e.g. whether you are wired in, on WiFi, or on cellular data; our systems add minimal latency. Global latency for international customers could be 300ms to 400ms at the worst, but you will still be able to have stable speeds and use a lot of data. Expected latency for international customers will generally be around 100ms. 

 

IP Address Privacy

When using VPN Alliance, all user traffic is masked behind our server IP addresses. As long as you use our quick configs and/or the OpenVPN Connect client, your connection will include automatic IP address cloaking. This includes full protection from IPv6 leaks, DNS leaks, and webRTC leaks; these are some of the features that set VPN Alliance above many other VPN services.
